Please read our Terms & Conditions carefully before requesting a booking on our website. By booking a lesson, you are confirming your agreement to be bound by the following terms.
1. Definitions
1.1 Terms used herein (and not otherwise defined) have the following meanings:
“Client”: means the individual to whom the tutor supplies the services.
“Company”: means Tomonokai Co.,Ltd., the provider of the teaching services.
“Booking”: means a certain number of teaching hours agreed by the Client and the Company.
“Tutor”: means the person who has completed the International Baccalaureate Diploma Programme and has been selected by the Company through the standard recruitment process. This individual provides the services to the Client, which is supplied by Tomonokai Co.,Ltd.
2. Service Details
2.1 The Website and Tutoring Services are provided by Tomonokai Co.,Ltd. (hereinafter referred to as “Tomonokai”, “we” or “us”), a company incorporated in Japan with company number 3011001034090 and with its registered office at Totate Nagai Bldg. 5F, 2-12-24 Shibuya, Shibuya-ku, Tokyo 150-0002 Japan. The website www.make-sensei.com is operated by Tomonokai Co.,Ltd.
2.2 We provide all information on our Website free of any access charge. The information provided on our Website is provided on the basis that we accept no liability for any not up to date, inaccurate or misleading information which without limitation, may contain statistical data which may have inaccuracies or errors. If you find that information on the Website is not accurate, please inform us at ask@make-sensei.com to have the information corrected.
2.3 Our Website also describes the post-paid online tutoring services which are available. For more information about the booking process, please refer to Online Tutoring.
3. Fees and Cancellations
3.1 The tutoring service provided for that month will be invoiced by e-mail by the 15th of the next month. The invoice is based on the teaching report that the Tutor submits to the Company on the last day of the teaching month. The fee is calculated by 15 minute increments, and will be rounded up.
3.2 Making study plans for the student, correcting students’ work, and any consultation on admissions and school work which may or may not be during the online session will also be invoiced.
3.2 The Client has the obligation to make a payment via Paypal payment service by the last day of the invoiced month. As the payment is non-refundable, we request the Client to notify us by e-mail if the Client does not agree with the number of hours or amount on the invoice.
3.3 Cancellation can be made without cost up to 2 hours prior to the booking by contacting your tutor directly by e-mail, and the tutor can confirm the e-mail has been received. If cancellation is made less than 2 hours prior to the booking, or the Client does not show up to a planned lesson, the Company has the right to charge the Client for 1 hour (70 USD) as a cancellation fee.
3.4 We will use our reasonable endeavour to provide the tutoring service advertised by Tomonokai Co.,Ltd. to satisfy the Client, but if the Client is not satisfied with their paired Tutor, the Client must notify the Company immediately by e-mail, and the Company will make the utmost effort to provide an alternative Tutor as soon as possible. The lessons that have already been taken can not be refunded.
4. Liability
4.1 Although every effort is made by the Company to give satisfaction to the Client by ensuring reasonable standards of skills, integrity, and reliability from Tutors, the Client understands the Company does not guarantee academic performance, results, or offers of entry to universities and is not liable for any loss, expense, damage or delay arising from any failure to provide any Tutor for all or part of the period of booking or from the negligence, dishonesty, misconduct or accidental damage to property during the assignment or lack of skill of the Tutor.
4.2 The Company does not accept any consultations other than that of academic or learning guidance.
5. Client Obligation & Acknowledgement
5.1 The Client and the Student will not engage any Tutor directly to provide services to the Student or otherwise agree to make any payments directly to any such Tutor, at any time during the Term.
Any breach by the Client or the Student of this clause entitles the Company to claim from the Client the value of the Services which would have otherwise been provided through the Company.

7. Governing Law and Jurisdiction
7.1 These Terms of Use are governed by and interpreted in accordance with the laws of Japan.
7.2 The parties agree that, in the event of a dispute involving these Terms of Use or the use of site content based on these Terms of Use, the Tokyo District Court is to be the court of exclusive jurisdiction in the first instance.
